By creating an account or using Smarkin AI, you agree to these terms. If you are using Smarkin AI on behalf of a business or agency, you confirm you have the authority to bind that organization to these terms.

2. What Smarkin AI provides

Smarkin AI analyzes marketing data from connected accounts (such as Meta Ads) and provides evidence-based reports, campaign assessments, creative analysis, and recommendations. Analysis is based on the real data available at the time and is subject to genuine limitations — recommendations are decision support, not guarantees of business or campaign outcomes.

3. Your account

• You are responsible for keeping your login credentials secure.
• You are responsible for the accuracy of information you provide and for any activity connected to your account.
• Agency accounts are responsible for ensuring team members and any client workspaces they manage comply with these terms.

4. Connected platforms

When you connect a third-party platform (such as Meta Ads), you authorize Smarkin AI to access the data that platform makes available under your authorization. You can disconnect a platform at any time from your account settings. We are not responsible for the availability, accuracy, or policies of third-party platforms.

5. Subscriptions and billing

Paid plans are billed on the cycle shown at checkout. You may cancel at any time; access continues until the end of the current billing period. Fees are non-refundable except where required by law.

6. Acceptable use

You agree not to:

• Use Smarkin AI for any unlawful purpose or in violation of any connected platform's own terms.
• Attempt to access another user's or workspace's data without authorization.
• Reverse engineer, resell, or misuse the service or its underlying intelligence.

7. Intellectual property

Smarkin AI and its underlying technology are owned by us. You retain ownership of your own business data; you grant us a license to process it solely to provide the service to you.

8. Disclaimers

Smarkin AI is provided "as is." Recommendations reflect the real evidence available at the time of analysis and honest confidence levels — we do not guarantee specific marketing results, and you remain responsible for your own marketing decisions.

9. Limitation of liability

To the maximum extent permitted by law, Smarkin AI is not liable for indirect, incidental, or consequential damages arising from your use of the service.

10. Termination

We may suspend or terminate accounts that violate these terms. You may stop using the service and close your account at any time.

11. Changes to these terms

We may update these terms from time to time. Continued use of Smarkin AI after changes take effect constitutes acceptance of the updated terms.
